1. Agreement to Terms
These Terms of Service ("Terms") form a legally binding agreement between you and Formidably Ltd, a company registered in England and Wales under company number 15228227 and trading as Formidably ("we", "us", "our"), governing your use of formidably.com including its courses, community, and content ("the Service"). Our registered address is Unit A Crescent Trade Park, Redditch B98 9DZ. By creating an account or making a purchase you agree to these Terms. You must be at least 18 years old to use the Service.
2. Accounts
You need an account to purchase courses or participate in the community. You are responsible for keeping your credentials secure. You must not share your account with anyone else. You are responsible for all activity under your account.
3. Courses
3.1 Licence
When you purchase a course, we grant you a non-exclusive, non-transferable, personal licence to access and view the course content for your own private study. You may not share your login, redistribute course materials, resell access, or use course content for commercial training without our written permission.
3.2 Pricing and Payment
Course prices are shown at checkout inclusive of UK VAT where applicable. Automatic tax calculation applies. Payment is processed by Stripe. We accept major debit and credit cards.
3.3 Permanent Access
Course access is a one-off purchase; there are no recurring fees for courses. You retain access for as long as the platform operates and your account is in good standing. We will give at least 90 days notice if we plan to withdraw access to a course.
3.4 Digital Content and Your Right to Cancel
Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel a digital content purchase. However, by completing your purchase and requesting immediate access to the course, you acknowledge that delivery of the digital content begins immediately and you agree that your right to cancel is waived once you access the content. If you purchase but do not access the content within 14 days, you may request a refund by contacting contact form.
3.5 Refunds
Outside the statutory cancellation window, we offer refunds at our discretion where the course has a material defect or where a significant portion has not yet been released. Contact contact form within 30 days of purchase to discuss your situation.
3.6 Intellectual Property
All course content including videos, scripts, written materials, and exercises is owned by Formidably Ltd or its licensors. Your licence to view it does not transfer any ownership rights. You may take personal notes but may not reproduce, record, or distribute the content.
4. Community
4.1 Access
Community access is included with relevant course purchases or available as a standalone benefit where stated. We reserve the right to restrict or remove community access if you breach these Terms.
4.2 Community Rules
When participating in the community you agree to:
- Be respectful of other members. No harassment, discrimination, or personal attacks.
- Stay on topic. Keep discussions relevant to the community purpose.
- Not post spam, unsolicited promotions, or affiliate links.
- Not post content that is illegal, defamatory, or infringes third-party rights.
- Not share other members' content or personal information outside the community without their consent.
We reserve the right to remove content or suspend accounts that breach these rules. Our moderation decisions are final.
4.3 Your Content
You retain ownership of content you post in the community. By posting, you grant Formidably Ltd a non-exclusive licence to display and store that content within the community platform. You are responsible for ensuring your posts do not infringe third-party rights.
5. Email Communications
By signing up for our email list you consent to receive Formidably updates. You can unsubscribe at any time via the link in any email. Transactional emails related to your account and purchases are not subject to marketing unsubscribe; they are sent as necessary to administer your account.
6. Acceptable Use
You agree not to:
- Attempt to gain unauthorised access to any part of the Service or other users' data.
- Use the Service for any unlawful purpose.
- Circumvent technical access controls.
- Transmit malware or use automated scripts that place unreasonable load on our infrastructure.
- Scrape, copy, or mirror course content by automated means.
7. Affiliate Programme
We operate an affiliate programme. If you participate as an affiliate, separate affiliate terms apply and are provided at signup. Affiliate commission is calculated on net sales and paid according to the schedule in those terms.
8. Limitation of Liability
To the fullest extent permitted by UK law, our total liability to you shall not exceed the total amount you have paid us in the 12 months preceding the claim. We are not liable for indirect or consequential losses, loss of profits, or losses arising from circumstances outside our reasonable control.
Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
9. Changes to the Service
We may update course content, add or remove features, or change pricing. For material changes to existing course content we will notify you by email. For price changes we will give at least 30 days notice.
10. Termination
We may suspend or terminate your account for breach of these Terms. On termination, your access ends. Course enrollment records and financial records are retained as described in the Privacy Policy.
11. Governing Law
These Terms are governed by the law of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales. We will always try to resolve disputes informally first; contact contact form before initiating formal proceedings.
